LicenseDigest ("the Service") is a weekly email report, with an Excel workbook and a CSV file, and on some plans a private web page (the "desk"), compiled from public records published by Florida counties and by the Florida Department of Business and Professional Regulation (DBPR). It is provided by Kummer Ventures LLC ("we", "us"). By subscribing you agree to these terms. LicenseDigest is an independent commercial publication. It is not affiliated with, endorsed by, sponsored by, or acting on behalf of DBPR, any Florida county, the State of Florida, or any government agency, and nothing in the Service is an official government record or communication.
Plans are billed every three months or yearly in advance through Stripe, as chosen at checkout. You may cancel at any time in the Stripe customer portal (the link is in your welcome email and in every GL list email) or by emailing support; cancellation takes effect at the end of the current billing period, a cancelled plan does not renew, and no new charges are made after it takes effect. We do not offer pro-rated refunds for partial billing periods, except where required by law or where we failed to deliver a report in a paid period, in which case we will credit or refund one month's share of the price (a third of a three-month plan, a twelfth of a yearly plan) on request. A one-time file is paid by invoice before it is sent and is not refundable once delivered, except where it was not what the invoice described.
All records originate from public records published by Florida counties and by DBPR and are reproduced as published, with classification, matching and grouping added by us. A general liability or workers' comp date is the date on file with the county on the date shown; a contractor may have renewed or changed carriers since. Public records contain errors and change without notice. The Service is provided "as is" and "as available" without warranty of any kind. You are responsible for verifying any record before relying on it, including with the contractor and with DBPR's own license search.
You may use the reports for your own business prospecting and research. You may not resell, redistribute or publish the reports or the underlying data, or use them to build a competing data product. You are solely responsible for complying with all laws that apply to how you contact anyone identified in a report, including the Telephone Consumer Protection Act, the National Do Not Call Registry, Florida's Telephone Solicitation Act (F.S. 501.059), CAN-SPAM, and applicable insurance and professional-conduct rules. The Service includes telephone numbers only where DBPR's or a county's records hold one, and only after screening them against Florida's then-current Do Not Call list. They are not screened against the National Do Not Call Registry. Before calling anyone, you must check the National Do Not Call Registry and comply with every law that applies to your calls and texts.
To the fullest extent permitted by law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental or consequential damages, lost profits or lost business.
We may change the Service, these terms or pricing with notice by email; continued use after the effective date is acceptance. We may suspend or terminate access for breach of section 4. We may discontinue the Service; if we do, we will refund any prepaid period not delivered.
These terms are governed by the laws of the State of New Jersey, where Kummer Ventures LLC is organized, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in New Jersey.
